In April 2025, the President of India, Droupadi Murmu, gave her assent to the ‘Immigration and Foreigners Bill, 2025’, officially making it a law following its notification in the Gazette of India. The new law focuses on addressing matters related to foreign nationals and immigration control.

  • - The primary objective of the Act is to strengthen national security, streamline immigration processes, and enforce strict penalties on foreign nationals violating entry or stay regulations in India.
  • - The new Act repeals four earlier laws that originated during the British colonial era, namely The Foreigners Act, 1946, The Passport (Entry into India) Act, 1920, The Registration of Foreigners Act, 1939, and The Immigration (Carriers’ Liability) Act, 2000.

💡 Other Important Facts:

  • (i) The Act explicitly states that any foreigner posing a threat to India’s national security, sovereignty, or integrity shall either be denied entry or refused permission to stay within the country.
  • (ii) On arrival, foreign nationals must register with a Registration Officer. The law also includes provisions that may restrict their movement, change of name, and entry into protected or restricted areas.
  • (iii) Foreigners entering without a valid passport or travel documents may face penalties including up to 5 years imprisonment, a fine up to ₹5 lakh, or both, as per the provisions of the Act.
