The Ministry of Corporate Affairs (MCA) has officially notified the Competition (Amendment) Act, 2023, which introduces significant changes to the regulatory framework governing mergers and acquisitions (M&As). This amendment aims to enhance the efficiency and transparency of the competition assessment process by refining the criteria for evaluating M&A transactions. Key provisions include updated thresholds for mandatory approvals and a streamlined review process to reduce delays. The move is expected to foster a more competitive market environment while ensuring that antitrust concerns are effectively addressed.
